What happens when someone is arrested in Newport Beach?
If one is arrested in Newport, Balboa or Corona Del Mar, they will be taken to the Newport Beach jail. Once there, the booking process starts. The booking process can take up to three hours and consists of warrant checks, finger printing, mug shots, health screening, and an interview with a detention and release officer. The results of the above actions, as well as criminal history and type of charge the individual is being charged with, will determine what happens next. An arrestee can be cited and released (release by citation), released on their own recognizance (O.R), bailed out, or they will be transferred to Orange County Men's Jail or Orange County Woman's Jail.
Regardless of what happens with the release or transfer, the person who was arrested will have to make an appearance in court to face their charges. When someone is bailed out, they are usually given an extra 30 days to prepare for their first appearance known as an arraignment. If they are not bailed out, they will be taken to court within 48 business hours. The arraignment is where the court declares the charges being faced and the defendant pleads guilty or not guilty. It is important to understand that very little happens at this first appearance. The defendant doesn't get to tell the judge his side of the story. If he pleads not guilty another court date will be set one to two weeks in the future. Unless bail has been posted or the judge decides to release the defendant on an OR release, they will remain in custody until the next court date.
