Orange County Bail Amounts & Orange County Bail Schedule
Bail schedules are the basis for which judges set the bail for individual people accused of crimes. Bail schedules were developed as a way to standardize an amount upon which a person who is arrested without a warrant may be released from custody prior to appearance in court. This both helps ease jail over crowding and reduces potential biases or disparities from one person to the next.
According to penal code 1269b It is the duty of the superior court judges in each county to prepare, adopt, and annually revise a uniform countywide schedule of bail for all bailable felony offenses and for all misdemeanor and infraction offenses.
Orange County, and California in general, have some of the highest bail amounts in the country. The Eight Amendment of the United States Constitution, provides that "excessive bail shall not be required."Â The right to bail was set forth by our country's founders to protect our rights to pretrial freedom.
